Terms of Service

Viswap transforms a photograph you upload. You choose one of the transformations we offer, and the service returns one edited picture. It is an automated service: results vary, and we do not guarantee that any particular result will meet your expectations.

You need an account to use Viswap. Accounts are provided through Noer Accounts. You must give accurate information, keep your credentials secure, and are responsible for activity under your account. We may suspend or restrict an account where necessary to protect the service or enforce these terms.

Because the account itself is a Noer Account, the Noer Terms of Use also apply to it, and govern the account, Noer Credits and payments across every Noer product. These terms cover your use of Viswap in particular. Where Viswap is silent, the Noer Terms apply.

You must be old enough to form a binding contract where you live, and at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher).

The service runs on Noer Credits. One transformation costs 20 Noer Credits. Credits are reserved when a transformation starts and charged when it completes; if it fails or is cancelled, the reserved credits are returned to your balance.

Noer Credits are account-wide. They are held in a single balance on your Noer account rather than inside Viswap, and can be spent in any supported Noer product that accepts them — including credits bought here. Different Noer products may use different amounts of credits for their features.

If a payment is later reversed, refunded, or charged back after some or all of the related Noer Credits have been used, we may remove any credits still remaining from that purchase. If the reversed amount is more than the credits remaining from it, your account may have an outstanding credit obligation. While that obligation is unresolved, paid features that use credits may be unavailable. You keep access to your account, your settings, and your history.

Credits are bought in packs. Payments for Noer Credits are processed by a third-party payment provider; the applicable provider and any provider-specific terms are presented at checkout. Prices are shown in USD; applicable taxes are determined and displayed at checkout. Credits are not transferable between accounts and have no cash value. Refunds are governed by our Refund & Cancellation Policy.

You keep whatever rights you have in the photos you upload. You grant us only the permission needed to run the service: to store your photo, process it to produce the result you asked for, and keep both available in your history until you delete them or your Noer Account.

You are responsible for having the right to upload each photo. Do not upload photographs of other people without their agreement.

You agree not to use Viswap to:

• impersonate a real person, or create misleading likenesses of one
• upload photographs of people who have not agreed to it, or of children in any sexualised context
• produce content that is illegal, harassing, hateful, or sexually explicit
• infringe anyone's intellectual property or privacy rights
• circumvent credit limits, abuse the service, or attempt unauthorised access to it

We may remove content and suspend accounts that breach this section.

The service is provided "as is" and "as available". We do not guarantee uninterrupted availability, and we may change, add or withdraw transformations over time. Where a change materially affects paid credits you already hold, we will act reasonably and in line with the refund policy.

To the maximum extent permitted by law, DevCave Technologies L.L.C-FZ is not liable for indirect or consequential loss arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law.

You can stop using Viswap at any time. There is no separate Viswap account to close: you sign in with a Noer Account, and you can delete it yourself from your Noer Account settings. Doing so ends your access to every Noer product, not only this one, and cannot be undone — the Noer account deletion page explains what it removes and what is kept. We may terminate or suspend access for breach of these terms.

We may update these terms from time to time. When we do, we will change the date at the top of this page. Continuing to use the service after a change means you accept the updated terms.
